1. What these terms cover

These terms govern your use of surestepeducation.com, operated by Sure Step Education LLC ("Sure Step," "we," "us"). By using this site, you accept them.

2. Our products are governed by signed agreements

Access to our products — DailyWins, TransitionReady, ParaScheduler, and others — is provided under written agreements with school districts, non-public schools, and their authorized staff, including student-data privacy agreements such as the California Student Data Privacy Agreement (CSDPA/NDPA). If anything on this website conflicts with a signed agreement, the signed agreement wins. If you're a teacher or administrator using one of our products, your use is governed by your organization's agreement with us, not by this page.

3. Individual subscriptions & your compliance responsibilities

Some Sure Step products — including BehaviorLog Pro — are available by individual subscription purchased directly through this site. If you subscribe as an individual, rather than through an organization's signed agreement, these Terms and the acknowledgment you accept at checkout govern your use. In that case:

• You are solely responsible for lawful use. You must comply with every law applicable to the data you enter, including the Family Educational Rights and Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), the Individuals with Disabilities Education Act (IDEA), the Health Insurance Portability and Accountability Act (HIPAA) where you handle protected health information, and any applicable state student- or health-data-privacy law.
• You must obtain the required authorization first. Before entering any student, child, or client data, you are responsible for obtaining every authorization, consent, or agreement your role requires — including your employer's or district's authorization, parental consent where required, and any Business Associate Agreement necessary for protected health information.
• You are responsible for the privacy of the data you enter. Sure Step provides the service with privacy and security safeguards, and we have taken significant measures on our side to support FERPA, COPPA, and related compliance. But you decide what data to enter and how you use it. Sure Step Education LLC is not responsible or liable for any use of the service by you that violates FERPA, COPPA, HIPAA, IDEA, or any other law, or for your failure to obtain any authorization or consent required for the data you enter.

4. Acceptable use of this site

Don't attempt to breach, probe, or disrupt the site or the systems behind it; don't misrepresent your affiliation with us; don't scrape the site to train commercial products. If you find a security problem instead, we'd genuinely like to hear about it: security@surestepeducation.com.

5. Our content and trademarks

The content of this site — text, design, images, and the sample documents we publish — belongs to Sure Step Education LLC. "Sure Step Education," "DailyWins," "TransitionReady," and "ParaScheduler" are our marks. You may quote or share site content for evaluation and procurement purposes (that's what it's for); you may not pass it off as your own or use our marks to imply endorsement.

6. Third-party services

Demo videos are hosted on YouTube and load only when you choose to play them; YouTube's terms apply to that playback. Links to our product sites (for example, dailywins.school) take you to services with their own notices and agreements.

7. Disclaimers

This site is provided "as is." We work to keep it accurate and current, but it is marketing and information — it is not a contract offer, legal advice, or educational advice, and product descriptions may evolve as the tools do. Formal commitments to districts are made in writing, in signed agreements.

8. Limitation of liability

To the maximum extent permitted by law, Sure Step Education LLC and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss, penalty, or claim arising from your use of this website or an individual subscription — including any regulatory penalty, third-party claim, or damage resulting from your violation of law or your failure to obtain a required authorization or consent. Liability related to products used under an organization's signed agreement is addressed in that agreement. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the service in the twelve months before the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Sure Step Education LLC and its owners, employees, and contractors from and against any claim, demand, investigation, loss, liability, penalty, or expense (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, or your violation of any law — including FERPA, COPPA, HIPAA, IDEA, or any student- or health-data-privacy law — or your failure to obtain any authorization or consent required for the data you enter.

10. Governing law

These terms are governed by the laws of the State of California, with venue in Sacramento County.

11. Changes

We may update these terms; changes are posted here with a new effective date. Continued use of the site after a change means you accept the updated terms.
